Teen tells of beach party 'strangling'

Teen tells of beach party 'strangling'
The jury trial is being heard at Wick Sheriff Court.

A TEENAGER has told a jury how a 21-year-old Caithness man tried to strangle her when she was at a beach party in Castletown.

Kelsey Johnson (17) who lives in the Thurso area. said Gary Gallacher started pulling her hair, shoved her face in the sand and put his hands round her neck.

“He started strangling me. He was on top of me and had his two hands around my neck and was putting his body weight on his two hands,” she told Wick Sheriff Court.

“I was going dizzy,” she said. A friend intervened and tried to get Gallacher off. Miss Johnson tried to lift herself up but said she was then punched in the face and was knocked out. “The next I knew I was waking up in a tent,” she said. She sustained cuts and bruises, a swollen black eye and a blood clot in the eye. Miss Johnson received medical attention for her injuries.

She had been with a group of friends at a beach party in Castletown on June 7 when the alleged incident occurred. Another group of people were also having a party on the beach and problems began when they got together, she said.

Miss Johnston said members of the other group were being confrontational. She took issue with a 15-year-old about his behaviour but he told her to shut up and shoved her. She shoved him back and after that Gallacher came up and started pulling her hair, she said.

Gallacher, described as a prisoner at Perth, and the 15-year-old who cannot be named for legal reasons, deny assaulting Miss Johnson, punching her repeatedly to the head, forcing sand into her mouth, putting their hands over her throat and choking her to her injury and danger of life.

The trial before, Sheriff Andrew Berry, resumes on Wednesday morning.

Mr Cannop, why not try some local gossip that isn't in the paper, you know we soak up that sort of stuff by the gallon. Might be an idea to substitute names though, you know what the locals are like,(nudge, nudge, wink, wink ).Don't give up, persevere.

Please can you remove this

Hello,

I am just wondering if somebody from this forum could remove this post please. If you are able to do that Paul then it would be much appreciated.

I was unanimously found not guilty by a jury of 14 people regarding this case and the 4 months in remand have already been damaging enough on my life. I am a university student and I am aware of the importance of how our presence online can have an effect on things like getting a job.

I would really respect if you took this article down.

Thank you for joining our forum, as this is a forum based on the concept of 'freedom of speech', we feel the removal of this post would be counter to this concept.

Unfortunately you were local news, we are happy you were found NOT GUILTY!

Feel free to tell your side of events here, as I'm sure many would like to hear it.

I only joined the forum to request that the post be removed...

I am not going to add fuel to the fire by commenting my opinion on the situation on a public profile. Too many small minded people in Caithness and this is clearly reflected in the admins reply of  'freedom of speech' !!! I hope all you tax payers (that's if you actually work) are happy at the tens of thousands of pounds wasted on keeping me in prison, etc. Chances are it will be even more expense on the tax payers money when I never get a job because of the situation... Especially if I am stuck in Caithness.

Hope you all have a wonderful life and such unfortunate circumstances never happen to you. At the end of the day you never know what's round the corner. Trust nobody in this world.

Gary

It is because of the small & narrow minded of caithness, that this forum was born.
Shit things happen to people, that's life!

Your bracketed comment, "(that's if you actually work)", is a perfect example of narrow mindedness.

If you let it stop you getting a job, that will be your doing, rise above!

Millions of pounds every year is wasted keeping innocent people in jail, you should think yourself lucky that you received a Not Guilty verdict, as many innocent people do serious time!

However with your story, I believed you innocent from the start.
You should try and use this experience to your advantage, not hide it away ashamedly, after all,  you have Nothing to be ashamed of have you!!

I have been the innocent accused, I know how it feels!!

I'd be much more worried about the other org which still, has the whole thing sitting there for all to read than this dark wee corner of the web. I doubt you'd get very far  getting something which is now a matter of public record expunged from the entire web.

since the jury returned a unanimous verdict of not guilty, i'm happy to believe he is not guilty. asking for the posts to be removed is also ok. but coming on here and calling admin narrow minded because he didn't get his way is not ok. nor is it ok to suggest that we don't work because he didn't get his way. he's a hypocrite.

Aye but if like he says the area Is full of narrow minded bigots then we should also take into account how inbred the area is and how likely it is that he has some extended family partaking in the jury so it's not worth a not Laughing

Take em down to engerland and let him sit in court with a jury of his peers their see if he gets off so lightly.

I'm pretty sure you will find the other org has taken it down!

Also there has been a court ruling against Google and I am legally entitled to challenge anything I want that comes up against my name in a search engine. It's a shame there's such a backlog but maybe in 2020 it will all be behind me and put in the past......

Here's a useful link for anybody.. you never know what the future holds.

I thought you weren't convicted. Much of the information in your link is to do with convicted people getting rid of their crime info.
Nothing has been written on here that would spoil your future. It is more important that YOU ensure that your conduct from now on is gentlemanly, honest and good. You won't go far wrong. It is easy enough to tell when someone has made an honest effort to prove themselves to be a worthwhile member of society. Move yourself forward, go out into the world and do good, you will reap tremendous rewards.

Then we have this little section

It is also important to remember that the exemption for journalism, art and literature under section 32 of the Data Protection Act can be applied by media organisations, bloggers and other publishers of information, depending on the circumstances. What this is not, then, is a full or absolute ‘right to be forgotten’.”

To Gary,
TORRANCE, Calif. – A woman who spent 17 years in prison for the death of a homeless man hugged her grandchild for the first time and did a dance of happiness on Friday after she was judged innocent of murder and freed.

"I always knew that one day God would bring the truth to the light," Susan Marie Mellen, 59, told reporters after she was released from a Torrance courthouse shortly before 6 p.m.

About eight hours earlier, a Los Angeles County judge overturned her conviction, saying that her attorney failed to properly represent her and that a woman who claimed she heard Mellen confess was a "habitual liar."

"I believe she is innocent," Superior Court Judge Mark Arnold said. "For that reason I believe in this case the justice system failed."

The courtroom burst into applause after his ruling.

Based solely on witness testimony, Mellen was convicted of orchestrating the beating death of Richard Daly at a Lawndale home where Mellen and others lived.

The mother of three was sentenced to life in prison without possibility of parole.

She was embraced by her three grown children after her release.

Mellen shrieked and clapped her hands as she kissed and hugged her 19-month-old grandson, Aiden.

"First time I held him," she told reporters.

"I'm a free woman now. Let me do the running man," she said, and did a few jogging dance steps before the microphones.

She joked and beamed but also described her imprisonment as "cruel punishment."

"I would cry every night" in prison, Mellen said, but never lost faith and even wrote "freedom" on the bottom of her tennis shoes "because I knew I was going to walk free one day."

Mellen's case was investigated by Deirdre O'Connor, head of a project known as Innocence Matters that seeks to free people who are wrongly convicted.

The witness who claimed she heard Mellen confess was June Patti, who had a long history of giving false tips to law enforcement, according to documents in the case. She died in 2006.

Three gang members subsequently were linked to the crime, and one was convicted of the killing. Another took a polygraph test and said he was present at Daly's killing, and Mellen was not there.

In a habeas corpus petition, O'Connor said the police detective who arrested Mellen was also responsible for a case in 1994 that resulted in the convictions of two men ultimately exonerated by innocence projects.

Mellen said she held no ill will against those who put her behind bars.

"No, no, I always forgave my enemies," she said. "Even your haters, you have to forgive them and sometimes you have to thank them because they bring you closer to God."

Mellen said she planned to go to dinner with her family and wanted to eat an avocado, steak, or maybe something she had never had.

She also hoped to have a McDonald's Happy Meal with her youngest daughter.

"Me and her were at McDonald's when I got arrested and we didn't have a happy meal that day," she said. "... It's a happy ending right now...We're going to have a new beginning."

As Mellen's family waited outside the courthouse before her release, her son, who has little memory of his mother because he was so young when she was imprisoned, opened his shirt to show reporters a broken heart he had tattooed on his chest to honor her. Donald Besch, 25 and in the Navy, said he was hoping to have some time with his mother before he is deployed overseas in a few days.

Daughter Jessica Besch, 27, said she and her fiancΘ of eight years were waiting to get married until her mother could be at the wedding.

"We're going to go dress shopping together," she said.

Her third daughter, Julie Carroll, 39, brought Mellen's grandson.

The children were raised by their grandmother and other relatives while their mother was in prison. They said they never told friends where she was or that she had been convicted of a crime she did not commit. - Associated Press, FOX News

I've only ever worn soft string vests as the stiff ones are rather unkind to the rosebuds. Now then, if you were to mention Karvol capsules- well that is a different matter altogether! Shocked
